Window tint is one of the most common things we’re asked about here in Victoria, and close behind it is the question: “Is this legal in BC?”
The short answer is that tint is legal on some windows and not on others. Here’s what the official rules say, in plain English.
This post is general information, not legal advice. Laws can change, so please check the current Motor Vehicle Act Regulations for the official wording.
What does BC law say about window tint?
BC’s tint rules are in section 7.05(8) of the Motor Vehicle Act Regulations (BC Laws). It reads:
“No person shall drive or operate on a highway a motor vehicle which has affixed to or placed on the windshield or a window any material that reduces the light transmitted through the windshield or window unless the material is affixed to or placed on
(a) the windshield but not more than 75 mm below the top of the windshield,
(b) a side window that is behind the driver, or
(c) the rear window if the motor vehicle is equipped with outside rear view mirrors on the left and right side of the motor vehicle.”
ICBC’s guidance for its partners summarizes the same rule: aftermarket tint is allowed only on the top 75 mm of the windshield, side windows behind the driver, and the rear window if the vehicle has outside mirrors on both sides (ICBC).
Notice that the regulation doesn’t set a percentage. It’s about which windows can have film, not how dark the film is.
Can I tint my windshield in BC?
Only a strip along the top. Film can go on the windshield but “not more than 75 mm below the top of the windshield” (MVAR s. 7.05(8)(a)).
Can I tint my front side windows in BC?
The regulation only allows film on side windows “behind the driver.” The RCMP’s BC traffic FAQ puts it plainly: for the front side windows (driver and passenger), “No tint of any kind is permitted, including light tint” (RCMP).
Can I tint my rear side windows and back window?
Yes. Film is allowed on side windows behind the driver. Film on the rear window is allowed if your vehicle has outside rear-view mirrors on both the left and right sides (MVAR s. 7.05(8)(b) and (c)).
What about factory-tinted glass?
Some vehicles come with tint built into the glass. Section 7.05(9) says: “If a motor vehicle contains manufactured glass, tinting contained within the glass must meet the minimum light transmittancy requirements under the Canadian Motor Vehicle Safety Standards.”
Is there a medical exemption for window tint in BC?
Section 7.05 doesn’t include a medical exemption, and we weren’t able to find an official BC program that offers one. If you have a medical concern, we’d recommend checking with RoadSafetyBC or ICBC directly before making any decisions.
What happens if my tint isn’t legal?
The RCMP’s BC traffic FAQ explains that police may take enforcement action, which can include:
- A violation ticket. The RCMP lists a typical fine of $109 for an improperly equipped vehicle.
- A “Box 2” Notice and Order, which requires you to remove the illegal tint and have the vehicle inspected at a designated inspection facility.
The RCMP also notes that failing to have the vehicle inspected within 30 days will result in a fine of $598.
